4 Steps to a Win

Last week we provided you with a detailed explanation of the 4 step process used by Review Commission Judges to determine whether companies are taking reasonable measures to prevent employee exposure to hazards in the workplace.

Today I have a shorter EQuickTip for you, but it comes with a link to a Review Commission Judge’s ruling on a case where a company successfully used OSHA’s Employee Misconduct defense to have a citation vacated.

The ruling provides an excellent example of how a company can meet its safety obligations by simply following its written safety policies and procedures, regardless of its size or assets.

For your convenience, I would suggest starting at the bottom of page 4 with the heading “EWD’s Fall Protection Safety Program” and reading through to item number 14 on page 7.

Employee QuickTip

Although employees cannot be cited by OSHA for their actions, employers do have the right to hold employees accountable if they violate their policies and procedures regarding safety. But more importantly, keep in mind that working safely is always in your best interest.
